Abstract :

This opus focuses on the question of gender and custom from the angle of practice on inheritance of land in Busanza in the territory of Rutshuru. Of course, the gender dimension is a reality in vogue as well as parity and the emancipation of women. In the Busanza group, the inheritance of women is confronted with the stereotypes and prejudices developed towards woman. These study recalls that congolese legislation on inheritance grants equal opportunities in terms of inheritance of immovable and movable property for theirs of the same category. Moreover, at the level of practice, we note the contrary acts so that the woman of Busanza group has visibly very limited access to land. The land is entirely managed by customs and traditions where the man has more preponderance than the woman. The woman only benefits from the land in circumstances tailored to the will of the man : upon the death of a parent as a consolation, the day of her marriage as a contibution to the foundation of her home or a simple gift following to his good habits. This article cleared up by saying that this only runs in families who have sufficient lands. Otherwise, on his wedding only benefits from a simple goat as a gift. This phenomenon continues to weaken women who remain financially dependent on men even if they are considered to be the keystone of the economy of this entity.
